For purposes of this agreement, the following terms apply:
Owner-Lessee: This is the property owner who has executed the annual lease with Beaufort Carts.
Lessee: The term used in the Beaufort Carts standard agreement used to designate either the guest who signs the agreement on the FrippIslandStay.com website or the Owner-Lessee when golf cart is used by the property owner, family, or any guest of the Owner-Lessee who did not sign the agreement on the FrippIslandStay.com website.
The Owner-Lessee agrees to the terms of this contract.
- The Owner-Lessee agrees to pay on the first of each month $370 for a 4 seat electric golf cart, $425 for a 4 seat gas golf cart or $475 for a 6 seat golf cart plus applicable sales tax every month for 12 months.
- The first payment is due on delivery of the golf cart to the Owner-Lessee’s property and on the same day for the next 11 months.
- Payments will be billed to Owner-Lessee’s form of payment on file automatically.
- Owner-Lessee agrees when they are operating the golf cart they are subject to the terms of Beaufort Carts’ standard lease agreement below.
- The Owner-Lessee is responsible for any guest of the Owner-Lessee that has not accepted the lease agreement below and operates the golf cart.
- The Owner-Lessee may not cancel this agreement without paying the entire contracted amount.
- This agreement automatically renews on the anniversary date unless written notice is provided 30 days prior to the anniversary date. The Owner-Lessee may cancel the agreement after the initial anniversary date with 60 days written notice given by the Owner-Lessee directly to Beaufort Carts.
- Maximum Increase: Notwithstanding any other provision herein, Beaufort Carts may increase the price(s) for the Services/Goods, provided that such increase shall not exceed 5 Percent of the then-current price(s) in any rolling twelve-month period. Any increases will include a 30 day notice period sent to the email address on file before taking effect.
Beaufort Carts agrees to:
- Maintain the golf cart’s batteries and other routine maintenance at least on a monthly basis.
- Work directly with Owner-Lessee’s guests that have accepted the Beaufort Carts agreement.
- Repair any mechanical issues not caused by Owner-Lessee or their guest
- Provide liability insurance for the golf cart.
Lease Buyout
Owner-Lessee will have the right after the first (1st) lease year to buyout the Lease upon ninety (90) days written notice and payment of Twelve Thousand Dollars ($12,000.00) to Lessor; and, after the (2nd) lease year, to buyout the Lease upon ninety (90) days written notice and payment of Ten Thousand Dollars ($10,000) to Lessor.
This is not an agreement with FrippIslandStay, the Property Managing Company, or the Property Owner. This is an agreement between you and Beaufort Carts, which is a separate company. By clicking the accept button for this agreement, you indicate your understanding of this.
The Lessee agrees to the terms of this contract.
- A valid driver’s license is required to operate golf cart
- Learner’s permit is allowed only if accompanied by a licensed individual 21 years of age or older
- Parent or guardian will be held responsible for minor’s violation
- Lessee is responsible for any damages to the leased golf cart
- Lessee agrees to follow all road legalities and regulations
Beaufort Carts is not responsible for any:
- Injuries
- Damages to golf cart while in Lessee’s possession
- Accidents
- Loss of property or damages to personal or real property
The Lessee is responsible for inspecting golf cart at time of check-in. Any signs of damage must be noted by Lessee and emailed to mike@beaufortcarts.com. Any damage not noted at check-in inspection is the responsibility of the Lessee. Damage includes: scratches, tears, broken lights, dents, burns and any other structural damage.
Lessee shall indemnify and save Beaufort Carts, it’s heirs, assigns, or successors free from any legal action, damages, loss, liability and any other expense in connection with loss of life, bodily or personal injury, or property damage arising from or out of the use of the cart(s) occasioned wholly or in part by an act or omission of the Lessee, it’s agents, heirs, or assigns.
The Lessee agrees to use the cart(s) solely for the purpose for which it is intended, obeying the laws, regulations, and restrictions pertaining to the use and operation of the cart(s). Neither Beaufort Carts nor the Lessee shall assign any right or interest in this agreement without written permission of the party and the Lessee shall not delegate any obligation owed by Lessee without written consent of Beaufort Carts. Any attempt of assignment or delegation is void, if the cart(s) is being provided as an additional benefit for the guests of the Lessee either personally or through a separate agreement, the Lessee shall remain responsible for any and all obligations under this agreement.
The Lessee agrees to receive marketing and purchase-related communication from Beaufort Carts via SMS text, email, and telephone.
